LASIK Malpractice

There are several treatment options for patients with nearsightedness (myopia) or farsightedness (hyperopia). One option is to have LASIK surgery, where an ophthalmologist reshapes your cornea to help you see better.

Bad LASIK results, whether from misprogramming the laser, operating on the wrong eye or operating on a poor LASIK candidate, can have life-changing consequences. Some LASIK centers hire fly-in doctors whom the patient only sees during the surgery and who delegates all pre- and post-operative care to others who are not medically trained. LASIK is an elective surgery, with disastrous consequences if incorrectly done or done on a bad candidate. Some patients who were bad candidates develop a corneal thinning process called "post-LASIK ectasia," which progressively gets worse throughout the patient's life. If you have had LASIK with a bad result, ask lots of questions and do so as soon as you suspect trouble.

Medical Negligence

A recent study by Johns Hopkins Medicine found that medical errors are the third leading cause of death in the United States, behind only cancer and heart disease.

To prove a medical negligence claim, a patient must show that the healthcare provider fell below the standard of care, and that the negligence caused harm to the patient. Sometimes, a patient will have sub-standard care, but luckily no serious harm came from the error. One of the worst things that we can tell a client is that they have a great malpractice lawsuit, because it means that something really wrong, and lasting, has happened to them unnecessarily.

Andy is married to a dentist and knows that most healthcare providers are doing their best and are certainly not intending harm. But errors are all-too-common, and when they happen to you or a loved one, it has devastating effects. When it happens, we are here to help.

Ophthalmology & Optometry Malpractice

We have a particular interest in eye cases against optometrists or ophthalmologists whose negligence has threatened patients' vision. If you have had bad outcomes following a retinal detachment, cataract surgery, LASIK, refractive surgery, PRK, glaucoma, endophthalmitis, posterior vitreous detachment (PVD), punctual plugs or other mistreatment from your eye professional, you should ask questions until you get straight answers. If you cannot get straight answers, then you should speak with a lawyer.

Personal Injury and Wrongful Death

Lawyers love catch-all phrases and this is one of them. Basically personal injury claims include negligent acts that harm other people. When that happens to you or a loved one, there are many pitfalls that can affect your ability to exercise your rights.

When somebody causes another's death, that person's estate may have a legal claim. These are called wrongful death claims, which present many legal and ethical pitfalls if done incorrectly. We have navigated these waters many times and can assist in having a personal representative appointed to investigate and pursue the claim.

Nursing Home Abuse and Neglect

The decision to admit a loved one to a nursing home or assisted living facility is a very difficult process. It is often plagued by feelings of guilt and self-doubt. The last thing these families should then face is the neglect of their loved ones by the people who should be caring for them. When these homes cut corners and make business decisions that put our elderly into harms way, we are here to help.

Governmental Negligence

If a state hospital or governmental employee harms you, you still have rights, but you must act quickly because of the shortened timeframe that you have to give notice of your intent to bring a claim, and ultimately bring a claim against the state.
